AlivePing – Terms of Service

1. Acceptance of Terms
By downloading, installing, or using AlivePing ("App"), you agree to be bound by these Terms of Service ("Terms").
If you do not agree, do not use the App.
AlivePing is operated by VerveAI Solutions ("Company," "we," "us," or "our").
2. Description of Service
AlivePing is a personal alert utility application that allows users to trigger notifications to designated emergency contacts.
AlivePing:
- Is not a medical device
- Is not a security monitoring service
- Is not a life-saving system
- Does not guarantee emergency response
Users acknowledge that emergency message delivery depends on third-party telecommunications providers and network availability.
SMS & Voice Alerts Terms
Program name: AlivePing Safety Alerts
- Safety/account notifications only (missed check-in reminders and emergency alerts)
- We do not send marketing or promotional messages
- Messages are sent only when the primary user misses a check-in (event-driven)
- Message & data rates may apply (SMS)
- Carrier voice call rates may apply (voice calls)
- Reply STOP to opt out of SMS messages.
- Reply HELP for help, or email support@verveai.ca.
3. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the App.
4. Account Registration
Users may sign in using:
- Apple ID authentication
- Google authentication
You are responsible for maintaining access to your authentication provider.
5. Emergency Contact Information
You are solely responsible for:
- Entering accurate emergency contact information
- Ensuring you have consent from listed contacts
- Updating contact details when necessary
We are not responsible for failed message delivery due to incorrect information.
6. In-App Purchases
All in-app purchases are processed exclusively by Apple Inc. through the Apple App Store.
Apple acts as the merchant of record for all iOS transactions.
We do not:
- Process payments
- Store payment information
- Issue refunds
- Override Apple's billing decisions
7. Refund Policy
All purchases made within the AlivePing iOS application are processed by Apple Inc. through the Apple App Store.
Apple acts as the merchant of record. Refunds are issued in accordance with Apple's App Store Terms and applicable consumer protection laws.
AlivePing does not process payments and does not have the ability to issue, manage, or override refunds.

Refund decisions are determined solely by Apple.
8. No Warranty
The App is provided "AS IS" and "AS AVAILABLE."
We make no warranties, express or implied, including:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Uninterrupted availability
9. Limitation of Liability
To the maximum extent permitted by law:
The Company shall not be liable for:
- Failure of message delivery
- Delays in SMS or call routing
- Telecommunications outages
- Personal injury
- Death
- Emotional distress
- Indirect, incidental, consequential, or punitive damages
Total liability shall not exceed the amount paid for the App.
10. Indemnification
You agree to indemnify and hold harmless the Company from claims arising from:
- Misuse of the App
- False emergency triggers
- Unauthorized contact listing
- Violation of these Terms
11. Termination
We may suspend or terminate access for:
- Abuse
- Fraud
- Violation of these Terms
12. Governing Law
These Terms shall be governed by the laws of: British Columbia, Canada, without regard to conflict of law principles.
13. Changes to Terms
We may update these Terms at any time. Continued use constitutes acceptance.
